Equipment Rental Terms and Conditions

Part One: Contract and Ownership

1. Parties and Acceptance: The Lessee's signature on the quotation, whether on paper or electronically, or its acceptance of it, constitutes final and binding acceptance of all these terms, and the quotation becomes a binding rental contract between the two parties.

2. Ownership of Equipment: The equipment remains the sole property of the Lessor throughout the rental period. The Lessee may not sell, pledge, sublet or move it from the work site stated in the quotation without the Lessor's written consent.

3. Delivery and Condition: The Lessee acknowledges receiving the equipment in good working condition and in the quantities stated in the delivery document. The signature of the Lessee, or of its representative on site, on the delivery document constitutes such acknowledgement.

Part Two: Rental Period and Charging

4. Rental Period: The rental period starts on the delivery date. The period stated by the Lessee is an estimate; rent is charged according to the actual period, price and calculation method agreed in the rental order. Any delay beyond the agreed date is charged as additional rent at the same daily rate until the actual return date.

5. Rental Day: A rental day ends at 9:00 PM, whether the equipment was received in the morning or afternoon; a day is not calculated as 24 hours from the time of receipt.

6. Stopping the Rent: Rent stops on the day the Lessor is notified that the equipment is ready for collection, provided its use has stopped and it is available for collection. Any delay by the Lessor in collecting it after notification is not charged.

7. Work Stoppage Days: The Lessor must be notified of any work stoppage days to be deducted (Fridays, rain or otherwise). Notification alone does not mean the deduction is accepted; the Lessor may accept or refuse the request, and no deduction applies without its explicit approval.

8. Operating Hours: The operating-hours system applies only to electric, diesel or petrol equipment and does not include scaffolding. The rent covers one 8-hour shift plus up to two extra hours free of charge. A second shift on the same day is charged additionally as agreed. Leaving the equipment unused until the next day is not considered an extra shift.

Part Three: Payment

9. Payment and Fees: The Lessee shall pay the rent on the dates set out in the quotation; delivery and collection fees are as agreed in the order and invoice. If payment is delayed by more than (15) days, the Lessor may stop the rental and remove the equipment from the site without notice, and claim all amounts due.

Part Four: Use, Breakdowns and Return

10. Use: The Lessee shall use the equipment only for its intended purpose, by qualified persons and in accordance with safety instructions, and is solely liable for any damage to third parties or persons resulting from its use.

11. Breakdowns: In case of any breakdown, the equipment must be stopped immediately and the Lessor notified. It may not be repaired or dismantled without the Lessor's consent.

12. Return: The equipment shall be returned complete with all accessories and in the condition received, allowing for normal wear and tear from ordinary use.

13. Damage and Loss: The Lessee is fully liable for any damage, loss or theft of the equipment or its accessories from receipt until return, except normal wear and tear. In case of damage, the Lessee shall pay the repair cost plus rent for the repair period; in case of loss or total damage, the Lessee shall pay the replacement value of the equipment, after the condition has been documented and the Lessee informed of the cost.

14. Failure to Return: If the equipment is not returned within (15) days from the end of the rental period or from the Lessor's request, the Lessee is deemed to have refused to return it and shall pay the rent due until the return date, or the full replacement value of the equipment in addition to the rent due.

Part Five: General Provisions

15. Evidence and Notices: The Lessor's records (quotations, delivery and return documents, invoices and messages) are binding evidence against the Lessee of delivery, return and amounts due. Messages sent to the Lessee's registered phone or WhatsApp number constitute valid and effective notice.

16. Collection Costs: The Lessee shall bear all collection and litigation costs resulting from its breach of these terms.

17. Jurisdiction: This contract is governed by the laws of the State of Kuwait, and the courts of the State of Kuwait have jurisdiction over any dispute arising from it.
